Center for Individual Freedom Lunchtime Liberty Update

Federal Issues:

Fried Legal Reasoning

Legal_Update Where's the injury?

That's the question the media should have been asking Tuesday when the Center for Science in the Public Interest (CSPI) announced a class action lawsuit against KFC for using partially hydrogenated oil, which contains trans fat, to cook its fried chicken, French fries, and other foods.

Freedom Line:
'Big Tofu' and You

Legal We've been writing about the Center for Science in the Public Interest (CSPI) and the other radicals who crusade against any food or drink that might taste good. With every whacky new proposal, they expand their agenda to limit our freedom to choose what we eat and drink.

And as we've sounded off, we've groped for a term that captured, in a word or two, their absurd agenda and the threat that it poses to our freedom. We've referred to them as the food police, nutrition nannies, anti-food zealots and pretty much anything that we could think of.

Legal Reform:
Turning the Tables on Abusive Tort Lawyers

Legal At long last, there's good news in the fight against "jackpot justice" tort claims and the nefarious law firms that file them. In courts and legislatures across the country, fraudulent lawsuits are being exposed, and the abusive tort lawyers that file them are finally getting a taste of their own medicine.

Most notable is the recent indictment of Milberg Weiss Bershad & Schulman, the nation's most notorious class-action law firm.

Get Ready for November's Democrat Landslide

Legal Get ready for Democrats to retake the House and Senate come November. You know you should because the mainstream media has been telling you to for weeks now. You see the signs everywhere, for yourself.

Fancy Nancy Pelosi has dropped her "culture of corruption" campaign. The numbers weren't looking so promising on that. At least she now knows she should have polled her House caucus members on how many expect to be indicted before she began it. Don't be so picky. She's moving in a "new direction." Someone will soon tell her which.

Energy: Guest Commentary
A New Low for 'Record' Highs
By Dan Gainor

Legal_Update Since Hurricane Katrina swept ashore on the Gulf Coast, we've heard seemingly countless reports of "record high" gas or oil prices. From the beginning of September last year, the big three networks -- ABC, CBS and NBC -- have told us about record high gas or oil prices close to 100 times.

They've been wrong each and every time.

CFIF Adds Its Voice to New Ad Campaign Against Regulating the Internet

Legal The Center for Individual Freedom this week joined several other conservative and free-market organizations on a new ad campaign renewing our demands that Congress resist calls to regulate the Internet.

Specifically, the ad, which is sponsored by Institute for Liberty and which ran this week in the Washington Times, responds to big government, pro-regulation groups like MoveOn.org that have amplified their calls for "network neutrality" legislation.

Featuring bizarre and sometimes humorous real life stories from the courtroom.
A Shell of a Lawsuit

Jester's Courtroom A judge in Long Island, New York recently dismissed a woman's lawsuit against a restaurant after she choked on a piece of mussel shell. Stating that the woman should have had a "reasonable expectation" that a shellfish dish could have shells in it, acting Nassau Supreme Court Justice John Galasso, added that the plaintiff had failed to prove the dish "defective."

According to the plaintiff, Mary Slaymaker, she suffered a punctured throat and an infection after choking on a one-inch piece of shell during her meal of mussels marinara. Ms. Slaymaker sued the restaurant for $750,000.

William Croutier, Jr., attorney for the Blue Moon Restaurant, said, "If you order shellfish, there's a reasonable expectation that there might be something of a shell-like nature in it."

Slaymaker's attorney declined to comment.

Notable Quotes:
Quote of the Week

Notable Quotes Claudia Rosett, Journalist-in-Residence at the Foundation for the Defense of Democracies, on U.S. Demands for United Nations Reforms:

"The U.N.'s real problem today is not that it has been hit with unfounded accusations, but that one after another, allegations of U.N. misconduct, mismanagement, conflicts of interest, and corruption have turned out to be true. ...The real question, as [U.N. Secretary General] Annan and Malloch Brown denigrate U.S. demands for reform, while holding their hands out for American tax money, is whether in this age of fascist movements, terror tactics, and weapons of mass murder, we can afford the indulgence of coddling as our leading global institution this sorry excuse for what was meant to be an honest forum for free and peace-loving nations."
