Selective Enforcement of Laws Being Used To Silence Donna Mancini

Donna Mancini is the third owner of her home, which has had an automatic pool cover on the pool since 1989.  It was never considered to be a problem until shortly after Mancini appeared on FOX-41 Point of View,  Jan 30, 2006, to express her disgust for her tax dollars being spent for a new arena on the waterfront in a flood zone.  The following week, Mancini was cited by the Metro Department of Inspections, Permits and Licenses for having a pool that does not meet the code, which requires a four-foot fence.

It should be noted that the code originated in 1963, before the technology of automatic pool covers existed.  These covers are often referred to as a horizontal fence, because they cover the water itself and can only be opened with a key. An automatic pool cover is the newest, safest, most effective state of the art technology for prevention of drowning and pool safety to date . There has never been a reported drowning of a child falling into a pool protected by an automatic pool cover.

Never-the-less, someone who did not like Mancini’s politics on the arena issue sent an anonymous e-mail to the enforcement authorities, and they were happy to go along with harassing Mancini and are continuing to harass her, despite her having shown them that her automatic pool cover is safer than a fence. 

“Seeing the pool cover in action and knowing that two people owned the house before me without a fence, convinced me that the pool cover was acceptable under the law, and gave me complete confidence that I was going above and beyond the call of duty as a  neighbor and citizen, to protect  trespassers from falling into  my  backyard pool.!!   

 Needless To say, I was   surprised when I was cited by Metro Government in the dead of winter, in the snow, for my Lack of a fence around my pool !! …“I  know from Personal experience that dissenters like me, who speak up and  resist being  robbed  and  forced  by bullies, get harassed and  threatened  by our so-called public servants”, said Mancini. 

 “ I am 55, grew up in the 60ties,  have enjoyed much  freedom and personal responsibility and  have  gotten  to live free in my lifetime…at least for a while. I  would like to die free as well,  but the possibility looks bleak…The younger generation, born and raised in the era of  Big Government, War,  and  regulation of  every orifice of your body and your   professional and personal life, is totally unaware of how and why freedom works and provides the best possible life for the most people, ALWAYS!!!!!!”
