Liberals Play the Terrorism Blame Game

Legal In the aftermath of last week's London bombings, most Britons and Americans turned their thoughts to the victims and their families. Many liberals, however, immediately turned their thoughts to the blame game.

Within hours of the first reports from London, Leftist commentators and bloggers were attacking President Bush and Prime Minister Blair, blaming them for the bombings.

Supreme Court:
The Supremacy of Five

Legal Each summer America learns about the supremacy of five.

Two years ago, five told us that equality under the Constitution means "not every decision influenced by race is equally objectionable" even though a "'core purpose of the Fourteenth Amendment was to do away with all governmentally imposed discrimination based on race.'"

A year ago, five informed us that they couldn't (and wouldn't) decide -- at least not then -- whether the phrase "one Nation under God" in the Pledge of Allegiance raised any First Amendment concerns because considering such "a weighty question of federal constitutional law" was "improper" when "hard questions of domestic relations" were "entwined inextricably."

Supreme Court Confirmation Watch:
Fairness Isn't Part of the Obstructionist Playbook

Legal As President Bush deliberates on whom to nominate to fill the first Supreme Court vacancy in more than a decade, it's worth contemplating the other side of the confirmation equation: the U.S. Senate.

For four years, liberals in the Senate tested strategies and tactics that they could employ to obstruct Senate confirmation of a Supreme Court nominee. And typically, their methods involve abusing the Senate's traditional confirmation process. Nominees to federal appeals courts like Henry Saad, Miguel Estrada and Charles Pickering have been victims of their obstruction. So have nominees to executive branch posts like John Bolton.

So with the Senate set to consider a nominee to the Supreme Court, it's worth considering what the Senate confirmation process should look like, and it is likely to be abused.

Busting Open Justice

Jester's Courtroom A Pennsylvania woman has filed a federal civil rights lawsuit claiming that rough treatment during her arrest for suspected prostitution led to the rupture of her breast implants.

The plaintiff, Susan Mator, was taken into custody on March 7. She asserts that the police officer, Sergeant Joseph Nixon, used excessive force in her arrest, improperly throwing her into his police car and damaging her artificial bosom in the process. Mator is seeking unspecified damages in excess of $75,000 for her alleged injuries and bust rupture. The lawsuit names both Nixon and the City of Arnold, Pennsylvania, where Nixon is a police officer, as defendants.

Mator has had other run-ins with the law and has an arrest record for drugs. But one of her lawyers, Harry J. Smail Jr., commends Mator for her courage in bringing the police brutality lawsuit: "She's very fearful, and frankly, it's taken all her nerve to get to this point."

Sergeant Nixon could not be reached for comment on the lawsuit, and the city's solicitor said he had received the complaint but had yet to read it.
