Norm Davis on eminent domain case

 

Read the decision.  http://a257.g.akamaitech.net/7/257/2422/23jun20051201/www.supremecourtus.gov/opinions/04pdf/04-108.pdf It said that the states have the right to make the laws and that the state here, Connecticut, ruled right by their laws. It also says that some states have stricter laws thatn the federal laws and that they can. While it was a loss for those people in New London it was a states right victory.

 

It is up to us citizens to make our legislatures do what is right. If you don't want to do the work to get the job done then find us people that will help. We have a bill coming this winter to change our laws so lets get busy in Kentucky and once again show the other states that, yes, it can be done. We had one hearing and will have another and the committee chairman has already said they need to make changes so get your people lined up. We can use this case as a "rallying cry" for our benefit.

 

A quote on page 19 reads;

We emphasize that nothing in our opinion precludes any State from placing further restrictions on its exercise of the takings power. Indeed, many States already impose "public use" requirements that are stricter than the federal baseline. Some of these requirements have been established as a matter of state constitutional law,22 while others are expressed in state eminent domain statutes that carefully limit the grounds upon which takings may be exercised.23

Now do you understand what I mean?

After todays ruling by the Supreme Court do you still think you live in a Free Country.  Wake

Up!  We have just lost one of the basic rights that our ancestors and founders of this county

fought for.  RIGHT TO OWN PROPERTY, we have lost that right today.  We either demand

that Congress does something about these renegade(communist Judges) or we go to war

with our own government to protect our rights under the Constitution.  It is time to Lock and

Load.
