Dear friends,

A very important American civic holiday is coming up -- one that far too many Americans are not aware of.

Perhaps you can help bring it to their attention.

December 15 is "Bill of Rights Day" -- a day to celebrate, honor and renew support for our precious Bill of Rights.

It was on December 15, 1791 that the Bill of Rights the first ten amendments to the United States Constitution -- went into effect.

One hundred and fifty years later, in 1941, "Bill of Rights Day" was officially recognized as a national civic holiday, and has been ever since.

The Bill of Rights is, of course, the great protector of American liberties. It boldly declares that people have certain inalienable rights that government cannot abridge -- fundamental rights like freedom of speech, freedom of religion, the right to keep and bear arms, and more. It also provides procedures for defending those rights -- such as fair trials and limits on federal power.

The Bill of Rights doesn't just belong to America. It has inspired freedom fighters around the world. The Founders viewed their Revolution as the first blow in a struggle to win liberty for *all* the people of the world -- so the Bill of Rights is truly a document for everyone.

That's why I hope libertarians and other freedom lovers will use this upcoming Bill of Rights Day as an opportunity to teach their families, friends, neighbors and others about our precious heritage.

It's a *great* time for a letter to the editor of your local newspaper, discussing the vital importance of our Bill of Rights freedoms and calling for reflection on our heritage -- and urging citizens to speak out against current calls to sacrifice liberty for (alleged) security.

To help with that, here's a short summary of the Bill of Rights, prepared by students at Liberty Middle School in Ashley, Virginia. (I've added just a few words.) While this condensed version doesn't have the majesty, depth and detail of the entire document, it is short and easy to understand, and may be useful to you in discussions and letters:

THE BILL OF RIGHTS: First Ten Amendments to the Constitution

1. Freedom of religion, freedom of speech, freedom of the press, right to assemble peaceably, right to petition the government about grievances.

2. Right to keep and bear arms.

3. Do not have to quarter soldiers during peacetime.

4. No unreasonable searches and seizures.

5. Rights of the accused.

6. Right to a fair trial.

7. Right to a trial by jury in civil cases also.

8. No cruel and unusual punishments.

9. Unenumerated rights go to the people.

10. Reserves all powers not given to the national government to the states or the people.

All Americans should be familiar with their Bill of Rights freedoms. Sadly, numerous surveys indicate most are not.

Those of us who love liberty should do our best to correct that.

Mary Ruwart Testifies: Gov’t Drug Regulations Kill Millions

Readers know Dr. Mary Ruwart as a Liberator Online columnist and renowned libertarian writer and activist.

She is also a research scientist -- a Senior Instructor with Sci-Com (Burnet, Texas) and Adjunct Associate Professor of Biology at the University of North Carolina in Charlotte.

On November 9, Dr. Ruwart made a controversial presentation at the 2004 Annual Meeting of the American Association of Pharmaceutical Sciences.

Her chief arguments? Government regulations are the cause of high drug costs -- and millions of people have died prematurely and unnecessarily because these regulations have slowed or halted the development of life-saving medications and other innovations.

"Regulations passed in 1962 are responsible for over 80% of today's drug prices," she says.

Development times for new drugs, about 4-1/2 years long, were stable for the two decades prior to the 1962 Kefauver-Harris Amendments that put new burdens on the development process. Since then, development times have soared. By the 1990s, the average drug spent over *14* years in regulation-mandated testing and FDA review.

"What we spend for prescription drugs can be predicted by what manufacturers spend on R&D," Dr. Ruwart explains. "If pre-amendment trends had continued, drug prices would be about 15% of what they are today. We'd have more innovation and twice as many drugs to choose from. Pharmaceuticals replace more expensive medical interventions like surgery, so that every dollar we spend on drugs lowers health care costs by $2-$3."

But don't regulations protect Americans from unsafe drugs? No.

"These particular regulations, the 1962 amendments, have proven to be more deadly than all of the drug toxicity that occurred before their passage," Dr. Ruwart claims.

Indeed, she estimates that between 1963 and 1999, 4.7 million people died prematurely while the medicine which could have saved them languished in mandated testing. "The amendments saved a few thousand lives, but the cost was letting millions die waiting for treatment.”

Should those upset about high pharmaceutical prices and development delays blame the FDA? Perhaps surprisingly, Dr. Ruwart doesn't think so.

"The FDA was told to enforce bad law," she points out. "The good people there, some of whom I've worked with, were put in a very difficult situation.

"Before we are regulators, legislators, members of the pharmaceutical industry, or cost-conscious consumers, we are all human beings who will one day need a life-saving medication or medical procedure," Dr. Ruwart contends. "For all of our sakes, the national debate on high pharmaceutical prices and affordable health care should include a thorough examination of the costs of excess regulation."

First-Time Marijuana Seller Gets 55-Year Sentence

On November 16, Utah Judge Paul G. Cassell gave a 22-year sentence to a murderer who beat an elderly woman to death with a log.

Two hours later, he sentenced nonviolent, first-time-offender Weldon Angelos, age 24, to 55 years and a day in essence, a life sentence.

Weldon’s crime? Selling a small amount of marijuana to a Utah undercover policeman.

How was this possible? It was yet another horror story created by America’s savage mandatory minimum sentencing laws, imposed by Congress during the “get tough on drugs” mania that seized Congress in the 1980s.

Angelos wore a small pistol in an ankle holster when he sold the marijuana. Although he didn’t use, threaten to use, or brandish the weapon, that triggered the federal mandatory minimum laws, and sent his sentence skyrocketing.

Angelos’ mandatory 55 years is based on three firearms-related charges: for carrying a gun during two drug sales and for keeping additional firearms at his apartment. Federal law require a five-year mandatory-minimum sentence for the first charge and a 25-year term for each count thereafter.

Under federal law, Judge Cassell had no choice but to impose the 55 years.

Cassell is no softie on crime. He’s a Bush appointee, former prosecutor, and death penalty advocate.

But he was horrified by what the law forced him to do to Weldon Angelos. So horrified, in fact, that he wrote a 67-page memorandum denouncing the mandatory sentencing and asking Bush to commute the sentence to a more reasonable (in his mind) 18 years.

Under federal law, Judge Cassell noted, an airplane hijacker would get 24 years. A bomb-detonating terrorist would get a 19-year sentence. A three-time child rapist would get 15 years.

"Is there a rational basis for giving Mr. Angelos more time than the hijacker, the murderer, the rapist?" Judge Cassell wrote. “To sentence Mr. Angelos to prison for the rest of his life is unjust, cruel, and even irrational."

A respected and growing body of individuals and organizations, from across the political spectrum, oppose mandatory sentencing laws. A few:

* Former attorney general Edwin Meese
* Former FBI director Louis Freeh
* Former drug czar Barry McCaffrey
* The American Bar Association
* The National Association of Veteran Police Officers
* The National Council of La Raza
* The American Psychological Association
* The National Association of Criminal Defense Lawyers
* The Federal Courts Study Committee
* The American Civil Liberties Union
* The U.S. Sentencing Commission
* Each of the 11 Federal Judicial Circuits

The Angelos case is bringing some well-deserved attention to the horrors and injustice of these barbaric laws.

But a libertarian analysis of the case goes much further than that. Two simple questions: Why should it be a crime to sell marijuana in the first place? And why should it be illegal to exercise your Second Amendment right to keep and bear arms while engaged in peaceful, consensual commercial activities?

Congressman Ron Paul Denounces New National ID Bill

The U.S. House and Senate have passed a sweeping new intelligence bill that contains provisions for a de facto national ID card. Congress passed the bill despite having only a few hours to read the 3,000-plus pages final version.

During the House debate, libertarian U.S. Rep. Ron Paul (R-Texas) rose to the floor to denounce the bill, particularly the national ID provisions.

“National ID cards are not proper in a free society,” Paul declared. “This is America, not Soviet Russia. The federal government should never be allowed to demand papers from American citizens, and it certainly has no constitutional authority to do so.

“A national identification card, in whatever form it may take, will allow the federal government to inappropriately monitor the movements and transactions of every American,” Paul continued. “History shows that governments inevitably use such power in harmful ways. The 9-11 commission, whose recommendations underlie this bill, has called for *internal* screening points where identification will be demanded. Domestic travel restrictions are the hallmark of authoritarian states, not free nations. It is just a matter of time until those who refuse to carry the new licenses will be denied the ability to drive or board an airplane.

“Nationalizing standards for drivers licenses and birth certificates, and linking them together via a national database, creates a national ID system pure and simple. Proponents of the national ID understand that the public remains wary of the scheme, so they attempt to claim they’re merely creating new standards for existing state IDs. Nonsense! This legislation imposes federal standards in a federal bill, and it creates a federalized ID regardless of whether the ID itself is still stamped with the name of your state.

“Those who are willing to allow the government to establish a Soviet-style internal passport system because they think it will make us safer are terribly mistaken,” Paul concluded. “Subjecting every citizen to surveillance and screening points actually will make us less safe, not in the least because it will divert resources away from tracking and apprehending terrorists and deploy them against innocent Americans! Every conservative who believes in constitutional restraints on government should reject the authoritarian national ID card and the nonsensical intelligence bill itself.”

Unfortunately, Republicans and Democrats alike failed to heed Paul’s warning. The bill was passed by the House 336-75 with 67 of the dissenters Republicans defying strong pressure from President Bush. The bill then passed the Senate 89-2. It could be signed by the president by week's end.

Interestingly, just one day before the U.S. House vote, the British government also announced plans to introduce biometric national ID card starting in 2008. According to Prime Minister Tony Blair: "With terrorism, illegal immigration and organized crime operating with so much greater sophistication, identity cards in my judgment are long overdue."

Opponents say the battle against a national ID, and the fast-growing national security state that supports such tyranny, will continue.

Is the libertarian “non-aggression” principle practical in the real world?

Question:

“In a recent Liberator Online column, you said: "It is not moral to force innocent bystanders to help us in our quest. Nor is it moral to kill bystanders who are obscuring our access to the aggressor."

”Given this, it sounds like taking hostages would be a very effective technique against libertarians. Does the more ruthless person, who is willing to endanger innocent lives, thus have an overwhelming advantage, if a society is based on libertarian principles?”

My short answer:

“Do thieves have an "overwhelming advantage" over those who work? Do cheaters have an "overwhelming advantage" against honest people? Do killers have an "overwhelming advantage" over those who live peacefully?

”My answer (and probably yours) is no. Because most people want to live in a society where their property, lives, and contracts are respected, aggressors are hunted down and stopped. Our police are generally instructed to let the aggressors escape, however, rather than shoot into a crowd or otherwise endanger those whom they are sworn to protect. Likewise, if we are trying to stop aggressors who are hurting innocent people (the example I was responding to), killing hostages used as human shields would defeat our purpose.

”A follow-up question a highly theoretical one, but interesting to explore -- might be: "What if a terrorist was holding 10 people hostage so that he could push the button to launch a nuclear missile at New York City. You can stop him with a grenade, but you'll kill all the hostages, too. What would you do?"

”My answer: I would throw the grenade and turn myself in to the authorities. In a libertarian society, I would be expected to compensate the victim's families, since I had taken innocent lives.

”The hostages' families might ask for nothing if they believed that their deceased would have gladly given their lives to save New York. Perhaps they would want compensation for the death of their breadwinners. If so, the grateful people of New York would probably volunteer to pay it for me.

”If New Yorkers would not come to my aid (unlikely if the threat were real), or if the families demanded my execution as a murderer, I would submit willingly. If I choose to sacrifice others, I should not flinch if my sacrifice is required, too. However, if I had used good judgment and truly saved New York, such a scenario is unlikely.

”Again, this is a highly theoretical example, useful mostly as a “thought experiment” to test and explore the furthest application of libertarian principles. In the real world, such extreme “lifeboat” situations rarely if ever happen, and consistently applying the libertarian non-aggression principle offers our best guide to achieving peace, liberty, abundance and justice.”

Personal Responsibility Sets Us Free

Personal responsibility sets us free. Personal responsibility makes us self-reliant. Self- supporting. Thoughtful. Productive. Personal responsibility makes us prosperous and civil.

Yet everywhere in America, government responsibility advances, while personal responsibility retreats.

Government responsibility expands, while personal responsibility shrivels and shrinks.

Government responsibility grows stronger, while personal responsibility grows weaker and weaker.

Why?

Because too many people have been taught that personal responsibility is a hard and painful burden.

Too many have been taught that personal responsibility means blame and punishment.

Too many people have been taught that personal responsibility is just one more thankless task.

So individuals surrender their responsibility to government. And Big Government is happy to take it.

Because Big Government grows by assuming responsibility.

But Government responsibility doesn't work.

Government responsibility makes things worse.

Government responsibility creates new problems.

Government responsibility means programs that squander and waste.

Government responsibility diverts money and energy from positive and productive uses.

Government responsibility IS the problem.

Personal responsibility is the solution.

Health Care? Federal, state, and local politicians vote and lobby for more government responsibility. They drive us toward a single-payer, Big Government health care monopoly. One big VA hospital for America. That's government responsibility in health care.

Education? Federal, state and local politicians vote for more government responsibility. More government authority. More government control. More government involvement. Government-run public schools are obscenely expensive and teaching disabled. That's government responsibility in Education.

The family? Politicians make politically correct votes for the children, for family leave, and family planning. Their votes destroy the authority and responsibility of parents. Their votes make more government rules and regulations, restrictions and requirements, mandates and demands ... decided and guided by bureaucrats and politicians. That's government responsibility for families.

Welfare? Disaster relief? Retirement? Business? Jobs? Area after area, time after time, government responsibility makes things worse.

Government responsibility is the problem. Personal responsibility is the solution.

It's time to take back personal responsibility.

Personal responsibility is the price of liberty. Personal responsibility sets us free. Personal responsibility leaves us with the freedom and resources to support our families, raise and educate our children, plan our careers, and save for our own retirements.

Personal responsibility is only possible with small government. And small government is possible only with personal responsibility.

Government responsibility or personal responsibility? Which do you want?

Government authority or personal authority? Which do you want?

Government control or personal control? Which do you want?

Big Government or small government? Which do you want?

It's your choice. Your responsibility.

You can pay the price of achieving small government, individual liberty, and personal responsibility.

Or keep paying the costs of Big Government, government authority, and government responsibility.
