Subject: Fw: Update: We The People v. United States

If you're not part of the 2000 standing together in this historic lawsuit, then please be a part of and stand with 20,000 people who will grow to 200,000 people and more.  Our strength will be in our numbers!

How often have you said or wondered; "When or why doesn't somebody do something about this out of control government that continues to grow and tax, and tax and grow."

How much of 100% of the fruits of your labor are you willing to give up to feed this overgrown and over-powering government? How much debt will you allow this government to pile on the shoulders of your children and grandchildren?

When is the last time you read the US Constitution and compared it to the actions of your government (both elected officials and the huge number of appointed bureaucrats that have been amassed) who all must swear an "oath of office" to protect and defend the Constitution?  That "oath of office" far too many times has been hollow to say the least and completely ignored at the worst.

Enforcement of the "oath of office" is up to the people to whom the oath is sworn; THAT IS YOU!  If you don't demand that government officials take their oath of office seriously (which we increasingly have not over the years) then we can expect nothing less than government increasing their reach outside of the bounds of the Constitution.

Insisting that our government obey the Constitutional restraints that are imposed on it by US (We the People) must consist of more than us shrugging our shoulders and saying "Well what can I do about it?"

Something can be done and something is being done and now you can join with thousands of other concerned citizens to formally demand and formally enforce the law and the Constitution so we can begin the difficult task of returning this "servant" government to the confines of their Constitutional authority.

All of us learned that our Constitutional Republic is a government "Of the people, by the people and for the people."  The only authority we have granted to the government is that written in the Constitution. Yet more and more often the people have lost control of government and far too often the people fear the government, particularly the evermore powerful IRS!

We have become far too dependent on government and now government controls the people instead of the other way around, and clearly the government steps increasingly farther and farther outside of their Constitutional authority.  This will continue unless WE stand together in great numbers that can not be ignored by the courts or by the media.  We must stand in great numbers and say "enough is enough" and demand that our government obey the Constitution which they are required to swear an oath to do.

Please read the following and learn about the actions we have taken so far and please join in this historic lawsuit and encourage as many people as possible to do the same.  Our strength will be in our numbers!

You can now do much much more than shrugging your shoulders and wondering when or if someone will do something.  That someone is you and the thousands of others that have and will join this action!

The question is not "when will someone do something" the question is WILL YOU?  There is no charge to join in this lawsuit, therefore the cost cannot be your excuse to do nothing!

Your willingness to help with a financial donation (however large or small) will only serve to help in this history making effort and will be greatly appreciated!

Thanks,
JR

Update:

We The People v. United States

What a difference 60 days makes: from 6 to 2,000 party-plaintiffs.

Thousands of Americans are now learning the meaning of the last ten words of the First Amendment and are exercising their Right to Petition the government for Redress of Grievances relating to:

a)   The war powers clauses of the Constitution and the Iraq Resolution.

b)      The “privacy” and due process clauses and the USA Patriot Act.

c)       The taxing clauses and the direct, un-apportioned tax on labor.

d)      The money and “debt” clauses and the Federal Reserve System.

On July 19, 2004, four People and two organizations filed a Complaint in the District Court for the District of Columbia. The Complaint seeks an Order:

“Granting declaratory relief to the Plaintiffs by constraining the defendants to meet their obligations under the law and relevant rules by entering into good faith exchanges with the Plaintiffs and to provide to the Plaintiffs documented and specific answers to the reasonable questions asked of them by the Plaintiffs and to address in their respective official capacities each of the issues raised by the Plaintiffs in their Petitions to representatives of the United States Government, namely: grievances relating to violations of the U.S. Constitution’s war powers, taxing, money, and ‘privacy’ and due process clauses.”

On September 16, 2004, the Complaint was amended, Nearly 2,000 people were added to the list of named Plaintiffs. The caption of the Complaint, with nearly 2,000 names and addresses, went from less than one page to 64 pages in length!

 No longer a “Class Action”

Rather than wait the many months it would take for the Court to identify and certify a “plaintiff-class,” or worse yet, be dependant upon the discretion of the Court to certify a plaintiff-class, we have decided to make the action a “class-action like” lawsuit, by dropping the “Class Action” designation and by greatly expanding the list of named plaintiffs.

From 2,000 to 20,000 to 200,000

It has been said that when the People are up against unjust civil government and laws, they can achieve the reform they are entitled to only if they are pro-active, non-violent and have a mass-movement.

Therefore, we intend to amend the complaint again, by increasing the number of named Plaintiffs tenfold – to 20,000.

Then, if possible, we would like to amend the complaint with another ten-fold increase in the number of named plaintiffs.

We intend to make it as difficult as possible for the government, including the Judicial Branch, not to take this matter seriously.

While only one person should be able to go to the court for a declaration of his or her Rights under the Petition Clause of the First Amendment, we know what is at stake and how politicized the Judiciary can be. We know, therefore, that to the government, it can be a numbers game.

In any event, we need to let the government know that we, the People, are serious in our Petitions for Redress of these Grievances.

PLEASE, do all you can to help us achieve our next goal of 20,000 named plaintiffs.

PLEASE, join the action (if you are not already on the list of named plaintiffs).

PLEASE contact your friends and associates with a request that they join the lawsuit.  If your friends and associates ask for more information about the We The People organization, let them know that if they send an e-mail to Bob@GiveMeLiberty.org, with their mailing addresses, we will send them one of our brochures.

It’s Free

There is no charge to join the Right To Petition lawsuit.

Mark Lane is the attorney. His fees are being paid by donations and contributions from the public at large.

Anyone wishing to contribute can do so by clicking here or by mailing their donation to We The People Foundation, 2458 Ridge Road, Queensbury, NY 12804.

An Apology

We apologize for the fact that people are having difficulties getting our website to properly respond to their commands. First, our IT person was forced to leave us and we were left guessing where all the source codes were located on our server and what the passwords were. Then our ISP made the terrible mistake of over- writing data on the drive that contained all of our mail functions.

We are working to cure the problems. We thank everybody for their patience.

Dick Simkanin

Many people have asked us how Dick Simkanin is doing.

The good news is he was moved to the federal “camp” at Texarcana. Dick tells us the facility is far better than the one he was at in Fort Worth.  Not only are the inmates those who have been convicted of “white collar” crimes, there are no fences, bars, barbed wire, etc. Dick is spending some of his time as a GED instructor, teaching math and science to inmates.

Everyone is urged to continue writing letters to Dick Simkanin. His new address is:

Richard Michael Simkanin
30383-177 Unit F
FEDERAL CORRECTIONAL INSTITUTION
P.O. BOX 7000
TEXARKANA, TX 75505-7000

Even though we have been contributing significantly to Dick’s Legal Defense Fund, we are unable to report on the progress of Dick’s appeal. Unfortunately, we have not been informed about the progress of the appeal by anyone on his legal team: attorneys Peter Goldberger and Robert Bernhoff and paralegal Tom Selgas. As soon as we hear something, we will pass it on.
