Here is the full text of the bill:
A JOINT RESOLUTION relating to prohibiting enforcement of restrictions on carbon dioxide emissions.
WHEREAS, the United States Congress and the federal Environmental Protection Agency (EPA) have threatened to regulate the emission of carbon dioxide under the 1990 Federal Clean Air Act amendments (Pub. L. 101-549, as amended); and
WHEREAS, the federal EPA has issued a finding that carbon dioxide is a harmful pollutant, thus allowing for the regulation of carbon dioxide emissions; and
WHEREAS, a recent disclosure of communications among scientists associated with the Climate Research Unit of the University of East Anglia has cast serious doubt upon the scientific data that have purportedly supported the finding that manmade carbon dioxide has been a material cause of global warming or global climate change; and
WHEREAS, the regulation of carbon dioxide emissions will have a deleterious effect on the people of Kentucky and their continuing prosperity;
NOW, THEREFORE,
Be it resolved by the General Assembly of the Commonwealth of Kentucky:
Section 1. No office, department, institution, agency, or political subdivision of state government shall enact or enforce any federal, state, or local law, regulation, ordinance, or executive order that limits, regulates, or controls the emission of carbon dioxide.
Section 2. Nothing in this Resolution shall be construed as prohibiting the United States government or any of its agencies from enforcing federal laws in the Commonwealth.
